Terms and conditions of use

§ 1
DEFINITIONS

  1. The terms used in the Regulations mean:
  1. Customer - a natural person, including a Consumer, who has reached the age of 18, as well as a legal person or an organizational unit that is not a legal person, to which specific regulations grant legal capacity, and who has placed or intends to place an Order or uses other services of the Online Store;

  2. Consumer - a natural person who performs a legal act not directly related to their business or professional activity;

  3. Seller - Krzysztof Piotrowiak Oakie, ul. Krótka 4, 64-130 Rydzyna, NIP: 6971012121 REGON: 410066250. Registered in the Central Register and Information on Economic Activity (CEIDG).

  4. Password - an alphanumeric sequence necessary for authorization during access to the Customer Account, set independently by the Customer during the Registration process;

  5. Account (Customer Account) - a subpage of the Store's website, where the Customer can, among other things, manage personal data, receive notifications about the change of Order status, and control and manage the status of Orders placed by them;

  6. Customer's Login (Login) - an alphanumeric sequence necessary to access the Customer Account, set independently by the Customer during the Registration process;

  7. Regulations - these Sales Regulations using means of distance communication and providing services electronically. With regard to services provided electronically, the Regulations are the regulations referred to in Art. 8 of the Act of 18 July 2002 on the provision of electronic services;

  8. Registration - a one-time, voluntary, and free action, consisting of creating a Customer Account by the Customer, carried out using the administrative panel provided by the Service Provider on the Store's website;

  9. Oakie Internet Store (hereinafter as "Store" or "Online Store") - an online service available at www.oakiestudio.com through which the Customer can place an Order.

  10. Goods - a movable item that is the subject of a Sales Agreement;

  11. Sales Agreement - a sales agreement within the meaning of the Civil Code, concluded between the Store and the Customer using means of distance communication through the Online Store, the subject of which is Goods;

  12. Order - a Customer's statement constituting an offer to conclude a Sales Agreement with the Seller, directly aimed at concluding a Sales Agreement at a distance through the Online Store, specifying the type and quantity of Goods that are the subject of the Sales Agreement.

§ 2
GENERAL PROVISIONS

  1. The Regulations define the rules for placing Orders using means of distance communication, as well as using the Online Store by Customers.

  2. The Online Store is run by Krzysztof Piotrowiak Oakie, ul. Krótka 4, 64-130 Rydzyna, NIP: 6971012121 REGON: 410066250. Registered in the Central Register and Information on Economic Activity (CEIDG).

  3. To use the Online Store, it is necessary to have a device with Internet access equipped with a web browser that supports cookies.

  4. To ensure the security of communication and data transmission in connection with the provision of the Service and the performance of Orders by the Customer, the Seller shall take technical and organizational measures appropriate to the degree of threat to the security of the Service.

  5. The Customer is obliged, in particular, not to take actions such as: sending or placing unsolicited commercial information in the Online Store; taking IT actions or any other actions aimed at acquiring information not intended for the Customer,

  6. The Service Provider uses Cookie files to collect information related to the use of the Store's website by the Customer to:

a) maintain the Customer's session (after logging in), thanks to which the Customer does not have to re-enter the Password on each subpage of the Store's website, and

b) adapt the Store's website to the Customer's needs, and

c) create statistics of subpage views in the above-mentioned website.

  1. Exclusive rights to content made available as part of services provided through the Online Store, in particular copyrights, the Store's name, the Store's trademarks, and manufacturers of Goods, graphic elements included in them, software, and database rights, are subject to legal protection and belong to the Seller or entities with whom the Seller has concluded appropriate agreements.

  2. Customers can access the Regulations at any time and free of charge by referring to the internet link (URL) posted on the main page of the Store and can print it out.

  3. Information about Goods provided on the Store's website, including their descriptions, technical and operational parameters, and prices, constitute an invitation to enter into an agreement within the meaning of Article 71 of the Civil Code.

§ 3
SCOPE, CONDITIONS, AND RULES OF USING THE ONLINE STORE

  1. The Seller undertakes to provide Services in the Online Store within the scope and under the conditions specified in the Regulations.

  2. The agreement for the provision of electronic services is concluded at the moment of effective completion and acceptance of the registration form by the Customer, or each time the Customer uses the Online Store (in case of no registration) after accepting the content of the Regulations.

  3. Registration within the Online Store takes place by accepting the registration form available on the website www.oakiestudio.com, after filling in the appropriate fields of the form.

  4. In order to ensure the security of communication related to the provided Service and the Customer's Orders, the Seller implements technical and organizational measures appropriate to the degree of security risk of the provided service.

  5. The Customer is obligated, in particular, to:

a) refrain from actions such as: sending or placing unsolicited commercial information in the Online Store; engaging in computer activities or any others aimed at obtaining information not intended for the Customer,

b) use the Store in a manner consistent with the provisions of the applicable law of the Republic of Poland, and the provisions of the Regulations,

c) not provide or transmit content prohibited by the provisions of the applicable law.

§ 4
ORDERS

  1. The Customer may place orders (purchase) for goods (i.e., enter into a distance selling agreement for the sale of Goods) through the Internet Shop.

  2. It is also possible to place orders for Goods by telephone or via email.

  3. Placing an Order constitutes an offer to conclude a sales agreement for the Goods, within the meaning of the Civil Code, submitted by the Customer to the Seller.

  4. The sales agreement for the Goods will be concluded upon the Customer's receipt of an email message as referred to in § 4(7) of the Regulations.

  5. In order to conclude a distance sales agreement for the Goods through the Internet Shop, the Customer should access the website www.oakiestudio.com, then select the Goods available in the Internet Shop, and place an Order indicating the place of delivery of the Goods, undertaking further technical actions based on the messages or information displayed to the Customer.

  6. Placing an effective Order is possible after accepting the Regulations.

  7. After placing an Order, the Customer receives an email message confirming the receipt of the Order by the Shop.

  8. The Customer has the right to withdraw from the execution of the Order before receiving the email message as referred to in § 4(7) of the Regulations. Within this period, the Customer is entitled to cancel the Order or place a new one. To do so, it is necessary to contact the Service Provider.

  9. Product prices are provided in Polish zlotys and are gross prices, meaning they include all components, including taxes.

  10. The Customer has the option to make the payment in the following ways:

a) through the payment system Przelewy24 - PayPro S.A. (credit card and e-transfer transactions are processed through https://dproxy.przelewy24.pl),

b) by bank transfer in the form of a prepayment to the Seller's bank account held at PEKAO S.A. with the number: 65 1950 0001 2006 0007 9362 0001.

  1. The Order for the Goods will be passed for execution immediately after concluding the sales agreement, and in the case of payment by bank transfer, the deadline will be counted from the date of the credit of the payment for the Goods to the Seller's bank account.

  2. In the case of placing an Order, the delivery of the Goods will be made no later than thirty (30) days from the date on which the sales agreement was concluded, unless otherwise indicated for the Goods or directly agreed otherwise with the Customer.

  3. Shipment is carried out through a courier company.

  4. Goods are delivered exclusively to addresses located within the territory of Poland.

  5. Delivery costs will be clearly indicated during the process of placing an Order.

  6. The cost of delivery for Goods with a value exceeding PLN 1000 is covered by the Seller, unless the purchased Goods, due to their nature (e.g., large dimensions, possibility of damage), require pallet delivery. The costs of pallet delivery will be communicated to the Customer at the stage of placing an order (before submitting the order).

  7. In order to effectively execute the Order, the Customer is obliged to provide all necessary data enabling its execution, i.e., name and surname, address (street, house number, city, and postal code), contact phone number, or other data indicated by the Seller through the Internet Shop website.

  8. Upon receiving the parcel with the ordered Goods, we suggest that the Customer checks the parcel, and we advise that if any of the following are observed:

a) mechanical damage to the contents of the parcel,

b) incompleteness of the parcel,

c) inconsistency of the contents of the parcel with the subject of the Order,

the Customer is entitled to refuse to accept the parcel. In such a case, we suggest making notes or remarks about the incident in the presence of the courier and promptly informing the Shop about the situation.

  1. In the case of pallet shipments, the Recipient must ensure the unloading of the goods from the courier's vehicle. The pallet shipment can be delivered by the courier to the nearest possible place for unloading, e.g., under the staircase. The purchase of the product with the "carry-in" option is possible for an additional fee.


§ 5
RIGHT OF WITHDRAWAL FROM THE AGREEMENT

You have the right to withdraw from this agreement within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day you acquire the last batch or part, or when a third party other than the carrier and indicated by you acquires the last batch or part.

To exercise the right of withdrawal from the agreement, you must inform us (Krzysztof Piotrowiak Oakie, ul. Krótka 4, 64-130 Rydzyna, contact@oakiestudio.com, Phone: 732 711 768) of your decision to withdraw from this agreement by an unequivocal statement (e.g., a letter sent by post or email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal from the agreement before the withdrawal period has expired.

Effects of withdrawal from the agreement:

If you withdraw from this agreement, we shall reimburse you for all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this agreement. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

You shall bear the direct costs of returning the goods (Consumers return the Products to the Seller at their own cost and risk). You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal through the agreement is available to consumers, as defined in the Act of May 30, 2014 on Consumer Rights.

The right of withdrawal by the consumer is excluded in the case of:

Agreements for the supply of goods made to the consumer's specifications or clearly personalized. Unless agreed otherwise, in the case of purchases made by a business, the right of withdrawal from a distance contract is not applicable.


§ 6
COMPLAINTS

  1. Oakie, as the seller, is liable to the Customer who is a consumer within the meaning of Art. 22[1] of the Civil Code, for warranty for defects within the scope specified in the Civil Code, in particular in Art. 556 and Art. 556[1]-556[3] of the Civil Code.

  2. Complaints resulting from the violation of the Customer's rights guaranteed by law or under this Regulations should be addressed to: Krzysztof Piotrowiak Oakie, ul. Krótka 4, 64-130 Rydzyna, contact@oakiestudio.com. Oakie undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer during this period when the complaint will be considered.

  3. Oakie takes actions to ensure the proper functioning of the Store, to the extent resulting from the current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.

  4. The Customer is obliged to immediately notify Oakie of any irregularities or interruptions in the functioning of the Online Store service.

  5. Irregularities related to the functioning of the Store can be reported in writing to the address: Krzysztof Piotrowiak Oakie, ul. Krótka 4, 64-130 Rydzyna, contact@oakiestudio.com

  6. In the complaint, the Customer should provide their name and surname, correspondence address, type, and date of occurrence of the irregularities related to the functioning of the Store.

  7. Oakie undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer during this period when the complaint will be considered.


§ 7
OTHER RIGHTS AND OBLIGATIONS

  1. Each Party may terminate the agreement for the provision of electronic services at any time and without giving any reasons, subject to the preservation of rights acquired by the other Party before the termination of the aforementioned agreement and the provisions below.

  2. A Customer who has registered can terminate the agreement for the provision of electronic services by independently deleting their Account, which involves submitting a request for its deletion or by requesting the Seller to delete the Account. In the case of submitting a request for Account deletion, the termination of the agreement takes place after the notice period of 5 days.

  3. The Seller, wishing to terminate the agreement for the provision of electronic services, shall inform the Customer to the email address provided by the Customer during Registration, within 14 days before the planned date of Account deletion.

  4. The Service Provider has the right to immediately terminate the provision of the Service in the event of the Customer's violation of the provisions of this Regulations and as a result of the unsuccessful summons to the Customer to cease the aforementioned violations within 1 working day.


§ 8
DISPUTE RESOLUTION

  1. The resolution of any disputes arising between the Seller and a Customer who is a Consumer shall be subject to the competent courts in accordance with the provisions of the relevant Code of Civil Procedure.

  2. The resolution of any disputes arising between the Seller and a Customer who is not a Consumer shall be subject to the court with jurisdiction over the Seller's registered office.


§ 9
PERSONAL DATA

Customers' personal data is processed by the Seller in accordance with the rules specified in the Privacy Policy and with respect for the provisions of the law in this regard, in particular the Act of August 29, 1997, on the protection of personal data.


§ 10
FINAL PROVISIONS

  1. Matters not regulated in this Regulations are subject to the provisions of universally applicable law, in particular the Civil Code, and the provisions of the Act of July 18, 2002, on the provision of electronic services.

  2. The current Regulations are published on the Store's website and provided free of charge to the Customer (electronically) upon each request.
